PROCLAMATION
Pursuant to Section 17-3(b)(3), Hawaii Revised Statutes, I, SCOTT T. NAGO, Chief Election Officer of the State of Hawaii do hereby proclaim that a special election will be conducted by mail and held on Tuesday, November 3, 2020 between the hours of 7:00 a.m. and 7:00 p.m. for the purpose of electing a State Senator to fill a vacant seat, caused by the death of the Honorable Breene Harimoto, from the Hawaii State Senate, Sixteenth District, for the unexpired term which ends on November 8, 2022. This election will be held in conjunction with the regularly scheduled General Election on the same date.
In recognition of Sections 11-102 and 15D-9, Hawaii Revised Statutes, and 52 United States Code Section 20302, and their conflict with the nomination deadline in Section 17-3(b)(3), Hawaii Revised Statutes, I am hereby proclaiming that party candidates for the Hawaii State Senate, Sixteenth District shall be nominated by the county committees of the parties and submitted to the Office of Elections not later than 4:30 p.m. on Saturday, September 5, 2020.
Nonpartisan candidates for the Hawaii State Senate, Sixteenth District, may file nomination papers. Nomination papers will be made available beginning on Wednesday, August 26, 2020, at the Office of Elections. Nonpartisan candidates to fill the vacant office shall file completed nomination papers not later than 4:30 p.m. on Saturday, September 5, 2020, at the Office of Elections. Pursuant to Section 12-5(d), Hawaii Revised Statutes, no signatures shall be required on nomination papers for candidates filing to run in a special election to fill a vacancy.
The nonpartisan candidate who is to be nominated will be decided by lot shortly after the close of candidate filing on Saturday, September 5, 2020, under the supervision of the chief election officer.
The Office of Elections will be open on Saturday, September 5, 2020.
The Intermediate Court of Appeals of the State of Hawaii will be petitioned in relation to this proclamation given the advancement of the nomination deadline to September 5, 2020. To the extent it renders an adverse determination regarding this proclamation, a subsequent proclamation consistent with its determination will be issued.
