YOU ARE HEREBY NOTIFIED THAT WAIANELA BOISER, as Personal Representative of THE ESTATE OF MARK BOISER ("Plaintiff’) has filed a Verified Complaint to Quiet Title (TMK NO. (4) 4-9-011-006) ("Complaint") in 5CCV-21-0000052, wherein Plaintiff prays for the following against you in the above-entitled Court: A) Defendants be required to set forth the nature of any claim to the subject property and that all adverse claims of Defendants or any of them be determined by a judgment of this Court; B) That the Court adjudicate and determine that all of the right, title and interest in and to the subject property is vested in Plaintiff, free and clear of all claims, liens, encumbrances or clouds of any kind; C) That all persons or parties be declared to have no estate or interest whatever in or to the subject property, and be forever barred from asserting any claim whatever in or to the subject property adverse to the interest of Plaintiff; D) In the alternative, if this Court finds Plaintiff is not the sole owner of the subject property, that this Court determine amounts owed to Plaintiff by co-tenants, if any; and E) That the Court grant any other relief as is just and proper.
YOU ARE HEREBY SUMMONED to appear in the courtroom (#6) of the Honorable Judge Kathleen N.A. Watanabe at 3970 Ka’ana Street, Lihu’e, Hawai’i, 96766 on TUESDAY, JULY 18, 2023 at 1:30 p.m., or to file an answer or other pleading and serve it before said day upon Plaintiff’s counsel, De Costa Hempey LLC, whose address is 4028 Rice Street, Suite B, Lihu’e, Hawai’i, 96766. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Complaint.
