NOTICE OF APPLICATION FOR VARIANCE RECEIVED BY
STATE OF HAWAII, DEPARTMENT OF HEALTH
Notice is hereby given that the County of Kauai, Department of Public Works, Wastewater Management Division has applied to the State of Hawaii, Department of Health for a Community Noise Variance pursuant to Chapter 342F-5, Hawaii Revised Statutes, and Title 11, Chapter 46, Hawai’i Administrative Rules.
The purpose of the project is to evaluate infiltration within the Wailua–Kapaa wastewater collection system. Work will include sewer line cleaning, closed-circuit television (CCTV) inspection of approximately 29,000 linear feet of gravity sewer main, and inspection of approximately 160 manholes.
The project area is located in the Wailua-Kapaa area, generally along Kuhio Highway and extending south to the Wailua Wastewater Treatment Plant.
Work within the State Department of Transportation right-of-way along Kuhio Highway will be conducted at night to minimize traffic impacts. Night work is scheduled to take place from August 1 through September 14, Sunday through Thursday from 9:00 p.m. to 12:00 midnight, and Monday through Friday from 12:00 midnight to 5:00 a.m.
Work will commence at the northernmost extent of the collection system, just south of Kaiakea Fire Station (Station 8), and will proceed along Kuhio Highway to Nehe Road. Activities conducted under this variance will be limited to the State Department of Transportation right-of-way along Kuhio Highway.
Construction activities will be performed by the County’s contractor using sewer jet/vac trucks and CCTV inspection equipment, which may generate noise levels exceeding allowable nighttime limits. A variance is requested to allow these temporary increases in sound levels during nighttime operations.
Noise impacts will be short-term, intermittent, and localized. Work crews will progress through the project area and will not remain in one location for extended periods. Reasonable measures will be taken to minimize noise, including proper equipment use and implementation of noise control practices.
The Department of Health will consider all written comments received within thirty (30) days after publication of this notice. The final decision will be based on the application, supporting documents, and any comments received.
