The State Department of Health (DOH) tentatively proposes to issue National Pollutant Discharge Elimination System (NPDES) permit to discharge storm water associated with construction activity from the 14 MW AC Combined PV and BESS project site, to receiving State waters, subject to special conditions to:

The proposed NPDES permit for the new discharge will expire five (5) years from the date of issuance.
The project is located at the Pacific Missile Range Facility, South Sidewinder Road, Kekaha, Island of Kauai, Hawaii, TMK: (4) 1-2-002:013 and as shown in the revised application, dated January 23, 2019.
The purpose of the project is to construct a solar farm on two sites, Site A and Site B. The project consists of constructing a temporary construction entrance and exit; installing BMPs including silt fences, dust screens, and concrete washout; clearing and grubbing; constructing gravel access roads, chain link fence, and gates; and final grading. The permittee is responsible for the design, implementation, operation and maintenance of the Storm Water Pollution Prevention Plan (SWPPP) to ensure that storm water discharges associated with construction activities will not cause or contribute to a violation of HAR, Chapter 11-54; Chapter 11-55; Chapter 11-55 Appendices C. Best Management Practices for storm water runoff and non-storm water sources will be implemented to minimize the discharge of erosion and other pollutants from entering receiving State waters.
The receiving waters, Pacific Ocean (PMRF beach), is classified by the DOH as Class A, Marine Water. It is the objective of Class A waters that their use for recreational purposes and aesthetic enjoyment be protected. Any other use shall be permitted as long as it is compatible with the protection and propagation of fish, shellfish, and wildlife, and with recreation in and on these waters. These waters shall not act as receiving waters for any discharge which has not received the best degree of treatment or control compatible with the criteria established for this class. No new sewage discharges will be permitted within embayments.
Persons wishing to comment upon or object to the proposed NPDES permits or to request a public hearing, should submit their comments or requests in writing no later than 30 calendar days after the date of this notice, either through e-mail at: cleanwaterbranch@doh.hawaii.gov or by mail at 2827 Waimano Home Road, Room 225, Pearl City, Hawaii 96782.
Copies of the proposed public notice permit and other information are available for public inspection, Monday through Friday (excluding holidays) from 7:45 a.m. until 4:15 p.m., at the DOH Clean Water Branch (CWB) office located at the 2827 Waimano Home Road #225, Pearl City, HI 96782 and the Kauai District Environmental Health Program Office, 3040 Umi Street, Lihue, Kauai, Hawaii 96766. All written comments and requests received on time will be considered. If DOH determines that there is significant public interest, a public hearing may be held after at least 30 calendar days of public notice.
If DOH’s position is substantially unchanged after considering all timely written comments and all oral comments at any public hearing that may be held, then the DOH will issue the NPDES permit and this action will be final.
