TERMS

Property to be sold "as is" by public auction with NO UPSET PRICE. The highest bidder is required to pay 10% of the bid price in cash, certified check or cashier’s check at the close of the auction with the balance payable concurrently with the delivery of the documents transferring title. If Plaintiffs are the highest bidder for the Property, no deposit shall be required at the auction for the Property and payment toward the sale price may be made by offset to the extent of the Plaintiffs’ interest in the net sales proceeds. The purchaser must display proof of the ability to pay 10% of the bid prior to the commencement of the auction. The purchaser shall pay the costs of conveyances, recordation, delinquent property taxes, if any, title insurance, if desired, and conveyance taxes, and shall pay for and be responsible for securing possession of the property. Successful purchaser may request the use of escrow and such purchaser shall be responsible for the costs.
