NOTICE OF FORECLOSURE SALE

LOCATION OF PROPERTY: 4049 Kaahumanu Place, Princeville, Kauai, Hawaii 96722. TMK No. (4) 5-4-016-013-0000.

DESCRIPTION OF PROPERTY: Offered for sale is the fee simple interest in a 1,826 sq. ft. single-family residence with three bedrooms, two bathrooms, and an attached garage, located on a 9,984 sq. ft. lot.

TERMS OF SALE: Property sold in "AS IS" condition without any representations or warranties whatsoever as to title or possession and by way of quitclaim conveyance to the highest bidder, at public auction without an upset price. Bidders must provide proof of ability to comply with 10% down payment requirement prior to the opening of the bidding. The successful bidder must pay 10% of the purchase price in cash, money order, by cashier’s check or by certified check immediately upon close of auction. The sale shall not be final until approved by the Court. The balance of the purchase price is payable concurrently with delivery of the documents transferring title. All costs and expenses of closing, including without limitation, the costs of conveyance, preparation of the conveyance document, conveyance tax, escrow and recording fees, any proof of title or title insurance, and notary fees, as well as the costs of securing possession of the Property, including the cost of eviction, shall be the responsibility of and paid by the purchaser. Neither the availability of title insurance nor securing possession of the Property is a condition of closing.

The purchaser is solely responsible for and the Commissioner makes no representations or warranties with respect to determining property boundaries, tax status of property, zoning requirements and restrictions, and property access. The Purchaser should conduct an independent investigation into these matters.

PUBLIC AUCTION: Friday, October 3, 2025, 12:00 p.m. at the Front Entrance to Fifth Circuit Court House located at 3970 Ka’ana Street, Lihue, Hawaii 96766.

OPEN HOUSES/INSPECTION: Saturday, September 20, 2025, from 12:00 p.m. to 3:00 p.m., and Saturday, September 27, 2025, from 12:00 p.m. to 3:00 p.m.

OTHER INFORMATION: The County of Kauai’s current assessed value for the property is $1,586,600.00. The Note on the property held by Plaintiff is $480,866.56, non-inclusive of interest, fees, and costs.
