YOU ARE HEREBY NOTIFIED that Plaintiff, MARILYN H. PLANAS, Trustee of the Marilyn H. Planas Self-Trusteed Trust, dated October 10, 2017, has commenced an action against the Estate of Christine V. Jerves, aka Christine J. Fox., et al. in the Circuit Court of the Fifth Circuit, State of Hawaii, Civil No. 5CCV-23-0000062, to determine and declare that Plaintiff has an easement for ingress and egress purposes and for utility purposes over and across the Roadway Lot, and to improve said Roadway Lot as may be necessary to accommodate vehicular traffic, and that the Clerk of the Court be authorized by order of this Court to execute any grants of easements as may be required by utility companies.
YOU ARE HEREBY SUMMONED to appear in the Courtroom of the Honorable RANDAL G. B. VALENCIANO, Judge of the above-entitled Court, 3970 Kaana Street, Lihue, Kauai, Hawaii, on Thursday, the 18th day of January 2024, at the hour of one o’clock p.m., of said day, or to file an answer or other pleading, and serve it before said day upon JONATHAN J. CHUN, Plaintiff’s attorney, whose address is 3135 Akahi Street, Suite A, Lihue, Kauai, Hawaii 96766. If you fail to do so, judgment by default will be taken against you for the relief requested in the Complaint filed herein.
