NOTICE OF INTENT TO REQUEST FOR RELEASE OF FUND
NATIONAL HOUSING TRUST FUND

TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS:
On or about November 7, 2017, the Kauai County Housing Agency will submit a request to the Hawaii Housing Finance and Development Corporation (HHFDC) for the release of the National Housing Trust funds under Section 1131 of Title 1 of the Housing and Economic Recovery Act (HERA) of 2008, as amended, to undertake a project known as Koa’e Workforce Housing Development for the purpose of the development of a 134-unit, workforce housing project, located in Koloa, Kauai, Hawaii.

PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the County Housing Agency at the address shown above. All comments received by November 6, 2017, will be considered by the County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

REQUEST FOR RELEASE OF FUNDS
On or about November 7, 2017, the County of Kauai will submit a request to HHFDC for the release of funds for the HTF Program Funds under Section 1131 of Title 1 of the Housing and Economic Recovery Act (HERA) of 2008, as amended, to undertake a project known as "Koa’e Workforce Housing Development" located at Koloa, Kauai, TMK: (4) 3-6-004:020, for the development of 134-unit workforce housing project.

FINDING OF NO SIGNIFICANT IMPACT
The County of Kauai has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the Nation Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the County of Kauai, Housing Agency, where the ERR is available for review and may be examined or copied upon request from 8 a.m. to 4 p.m., Monday through Friday, except holidays, or on the County’s website, www.kauai.gov.

ENVIRONMENTAL CERTIFICATION
The County Certifies to HHFDC that, Bernard P. Carvalho, Jr., in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HHFDC’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the County of Kauai to use HTF funds.

OBJECTIONS TO RELEASE OF FUNDS
HHFDC will accept objections to its release of funds and the County of Kauai’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the Certifying Officer of County of Kauai; (b) the County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR part 58 before approval of release of funds by HUD; or (d) another Federal agency actions pursuant to 40 CFR Part 1504 has submitted a hand written funding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec 58.76) and shall be address to Janice Takahashi, Chief Planner, Hawaii Housing Finance and Development Corporation, 677 Queen Street, Suite 300, Honolulu, Hawaii 96813. Potential objectors should contact HUD to verify the actual last day of objection period.
