DESCRIPTION OF PROPERTY: Coco Palms Resort, 4-231 Kuhio Highway, Kapaa, HI 96746, Kauai TMK: (4) 4-1-003-007 (CPR Nos. 1 through 216); 4-296 Kuhio Hwy, Kapaa HI; Kauai TMK: (4) 4-1-005-014; and Kauai TMK: (4) 4-1-003-004.

Per order of the court, viewing of the property will be by appointment only upon request of prospective bidders.

AUCTION DATE: Monday, July 26, 2021, 12:00 p.m., Fifth Circuit Courthouse, 3970 Kaana Street, Lihue, Kauai, Hawaii (front steps).

TERMS OF SALE: No upset price. Property to be sold in "AS IS" condition, without any warranty of title or any other warranty, at public auction with 10% of highest bid payable in cash, money order, by cashier’s check or by certified check at close of auction. Prior to bidding, any person not authorized to credit bid must show in confidence to the Commissioner such person’s present ability to make the required down payment immediately upon the close of bidding. The down payment to be made to the Commissioner shall be in an amount not less than ten percent (10%) of the successful bid price. The balance of the purchase price shall be paid in cash, money order, by cashier’s check or by certified check upon delivery of documents transferring title. The purchaser shall bear all the costs and expenses of the closing of the sale, including without limitation, the costs of conveyance, including the preparation of the conveyance document, conveyance tax, escrow and recording fees, any proof of title or title insurance, and notary fees. The costs of securing possession of the mortgaged property, including the cost of an eviction, shall also be the responsibility of and paid by the purchaser. Neither the availability of title insurance nor securing possession of the mortgaged property shall be a condition of closing. The sale is subject to any outstanding real property taxes. SALE SUBJECT TO COURT CONFIRMATION.
