NO UPSET PRICE, the property to be sold in "AS IS" condition at public auction with 10% of highest bid payable to the Commissioner in cash or by way of certified or cashier’s check, at close of auction. The balance of the purchase price shall be paid to the Commissioner upon approval and confirmation of the sale. The Commissioner may require the sale close through an escrow, even if the purchaser does not require one. The purchaser shall bear all costs and expenses of closing, including, but not limited to the following: costs of drafting the conveyance document, conveyance taxes, notary fees, consent fees, escrow and recording fees, any proof of title or title insurance, costs of securing possession of the property, and any orders of the Court. Neither the availability of title insurance nor securing possession of the subject property shall be a condition of closing. The sale is subject to any outstanding real property taxes.
