NO OPEN HOUSES: Pursuant to Court order, no open houses or showings of this property will be scheduled.
AUCTION DATE: January 4, 2018, at 12:00 noon, Courthouse steps, Fifth Circuit Court Building, 3970 Ka`ana Street, Lihue, Kauai, Hawaii.
TERMS OF SALE: No upset price. Property sold “as is” condition at public auction with a minimum of ten percent (10%) of the highest bid payable by money order, certified check or cashier’s check, made payable to Ryan E.Jimenez, Commissioner, at the close of the auction, the balance payable upon
delivery of title. Potential bidders shall be required to provide proof of ability to comply with the minimum 10% bid requirement prior to participating in the auction. Conveyance will be by Commissioner’s Quitclaim Deed.
The purchaser shall pay all costs of closing, including escrow, conveyance and recordation fees, title insurance, and conveyance taxes. The purchaser shall be responsible for securing possession of the property upon recordation. The 10% down payment may be forfeited if the purchaser fails to close on the transaction for the conveyance of the property. Purchaser may also be assessed up to 6 months of unpaid regular monthly condominium association common assessments in the form of special assessment at the foreclosure sale.
