Plaintiff had purchased TMK (4) 5-8-007-017 (''Premises") via a Kauai County Tax Auction in 2010. Real estate taxes on the parcel were unpaid for years 2005 through 2010 inclusive. The County had filed and foreclosed a tax lien. Plaintiff purchased the property as high bidder in a public auction in which the County had notified all owners for whom it had addresses, and public notices.
